Terms of Service

Beta draft for review before public launch. These pages do not certify legal compliance. Operator identification and a working contact address must be completed before public use.

Last updated: 4 November 2026.

Service: Keki Market. Operator: not yet provided.

Keki's role

Keki Market provides cake discovery, pickup order requests, and recordkeeping tools for independent bakeries. The bakery identified on a listing is the seller. Keki does not bake, inspect, store, or deliver cakes, collect customer payments, hold deposits, or provide escrow. A bakery is not Keki's employee or agent merely because it uses the service.

Bakery approval allows marketplace access; it is not a food-safety certification, guarantee of identity or licensing, or promise of performance. These terms do not remove Keki's own legal duties as a platform or responsibilities that applicable law places on its operator.

Accounts and acceptable use

  • Use an account you are authorized to use, protect access to it, and provide accurate contact details.
  • You must have legal capacity to enter a transaction, or an authorized parent or guardian must act for you.
  • Do not impersonate others, submit fraudulent orders or receipts, misuse personal information, or upload content you have no right to use.
  • Do not offer unsafe or unlawful goods, harass others, interfere with the service, or attempt unauthorized access.

Order requests, prices, and pickup

  • A request is pending until the bakery accepts it. Check its status and agree outstanding details directly with the bakery.
  • Keki calculates the submitted order total from selected catalog options and saves it with the order. Later catalog changes do not automatically change an existing order.
  • Changes or extra charges must be clearly disclosed and agreed by the customer and bakery; they must not be imposed retrospectively without agreement.
  • Orders are for pickup. Dates and times use Asia/Manila. Confirm the location, schedule, cake details, and contact number.
  • Customers must give accurate instructions, attend the agreed pickup, and follow reasonable transport and storage instructions.

Bakery responsibilities and food safety

Each bakery is responsible for truthful listings and images, prices, ingredient and allergen information, applicable permits and registrations, food preparation and safety, packaging, legally required invoices or receipts, availability, and fulfilling accepted orders. It must maintain accurate contact details and promptly tell customers about delays, errors, or inability to fulfil an order.

Discuss allergies and dietary needs with the bakery before ordering. A name, filter, or customization option does not establish that a cake is allergen-free. Bakeries must accurately disclose known ingredients and cross-contact risks and must not accept requirements they cannot meet. No wording here excuses unsafe food or removes legal remedies.

Account access and security

Supported sign-in options are Google and, when a verified sender is configured, verified email/password and passwordless email links. Unconfigured options are disabled. Use an email address you control, keep passwords and sign-in links private, and do not open links you did not request. Magic links expire and can be used only once. Password reset ends existing sessions. Creating or signing in to an account does not approve a bakery; seller approval and onboarding requirements still apply. No account-linking right or ability is promised between Google and email credentials. Development-only demo accounts are not real customer or bakery identities.

Payments, cancellations, and refunds

Payment is arranged directly with the bakery. Verify the recipient and amount before paying. Payment entries and uploaded screenshots are user-supplied records; they do not verify that a bank or GCash transfer succeeded and are not Keki-issued payment receipts or payment guarantees.

Customers can cancel pending requests in Keki. After acceptance, contact the bakery about changes, cancellation, missed pickup, or refunds. Bakeries must disclose deposit and cancellation conditions before payment and handle refunds they owe. Keki cannot reverse off-platform transfers. A bakery's policy cannot remove statutory remedies for unsafe, defective, misdescribed, or unfulfilled goods. These terms create no blanket no-refund rule or automatic forfeiture of deposits.

Records, AI, and availability

Sellers must be authorized to enter customer details, receipts, and other records and check their accuracy. Optional AI extraction produces an unsaved draft and may get dates, times, quantities, or cake options wrong. Review every field and confirm uncertain details before saving. AI does not accept orders, authorize payments, or make binding decisions.

Financial summaries depend on recorded entries. They are not a verified wallet balance, complete accounting records, tax advice, or a guarantee of profit. Keep independent records of important orders and transactions and reconcile entries with actual payments. Calendar and reminder tools depend on accurate records and do not guarantee that every conflict or deadline is detected.

The beta may have bugs, interruptions, or unavailable third-party features. To the extent permitted by law, the service is provided as available without a guarantee of uninterrupted or error-free operation. This does not limit mandatory standards or Keki's obligation to exercise required care.

Responsibility and limits of liability

Each user is responsible for their own unlawful acts, misrepresentations, and failure to meet their obligations. To the extent permitted by Philippine law, Keki does not guarantee a user's conduct or assume a bakery's obligations merely by hosting its listing or recording a request. Keki is not responsible for losses caused solely by a customer's or bakery's conduct where Keki has no responsibility for that loss under applicable law.

To the extent permitted by law, Keki excludes liability for indirect or consequential losses and lost profits arising from use of the service. Nothing excludes or limits liability for fraud, intentional misconduct, gross negligence, violations of data-protection duties, injury or death where liability cannot lawfully be excluded, or any other non-excludable responsibility. Mandatory consumer rights, remedies, and platform obligations prevail over conflicting wording.

Complaints and unsafe listings

For an order issue, contact the bakery and keep the order reference, agreed terms, payment evidence, and relevant messages. Report suspected fraud, unsafe food, unlawful listings, privacy concerns, or platform errors to Keki at Contact address not yet configured. This draft is not ready for public use.. Include the listing or order reference and issue details; do not send passwords, OTPs, or unrelated personal information.

Keki may investigate reports, request relevant information, and restrict accounts or remove listings where reasonably necessary for safety, suspected misuse, or legal compliance. This does not guarantee reimbursement or replace action required by law. Nothing here prevents complaints to the DTI, NPC, other competent authorities, or courts, or changes statutory complaint periods and procedures.

Mandatory Philippine protections

The Consumer Act (Republic Act No. 7394), Food Safety Act (Republic Act No. 10611), Data Privacy Act (Republic Act No. 10173), and Internet Transactions Act (Republic Act No. 11967) may impose duties and remedies according to the facts and applicable implementing rules. Calling Keki a marketplace or arranging payment outside it does not by itself remove platform obligations or liability. In particular, applicable marketplace diligence, merchant-information, complaint, takedown and data-protection duties must be observed. Statutory subsidiary or solidary liability is not excluded by these terms.

Use the applicable complaint procedure. Section 24 of the Internet Transactions Act addresses internal redress and when it is deemed exhausted; nothing here extends that period or prevents urgent safety reports, required notification, or other remedies allowed by law. The operator has not yet established a working Keki inbox or completed the operational steps needed to publish these drafts. Do not rely on an unconfigured contact placeholder to submit a report.

Privacy, samples, and changes

The Privacy Policy explains personal-data handling. Accepting these terms is not blanket consent to optional location sharing or AI processing. Listings marked Sample are fictional testing data and must not be used for real transactions.

Philippine law applies without removing mandatory rights or legally required jurisdiction. If a provision is unenforceable, remaining lawful provisions continue to apply. Revisions are dated on this page; changes must not retrospectively remove accrued rights or rewrite accepted orders.
